1. Introduction

Welcome to Furiona, an anime-themed entertainment Discord bot developed and operated by wsquarepa productions ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of Furiona (the "Bot" or "Service").

By installing, accessing, or using Furiona, you agree to be bound by these Terms. If you do not agree to these Terms, you must not install or use the Bot.

2. Description of Service

Furiona is a user-installable Discord bot that provides anime-themed entertainment features, including image commands, social action commands, expression commands, and anime search functionality. The Bot operates within the Discord platform and is designed for entertainment purposes only.

2.1 Key Features

The Bot provides the following categories of functionality:

• Image Commands: Display random anime-style images (such as neko, waifu, husbando, and kitsune images) with refresh capabilities.
• Action Commands: Enable users to perform social interactions with other Discord users (such as hug, pat, wave, and similar actions), complete with animated responses.
• Expression Commands: Allow users to express emotions or actions without targeting another user (such as dance, laugh, shrug, and similar expressions).
• Anime Search: Search for anime information using data sourced from MyAnimeList via the Jikan API.
• Virtual Economy: Participate in a virtual economy system including daily rewards, mora transfers between users, and gambling games (coinflip, dice, and slots).

2.2 User-Installed Application

Furiona is a user-installed Discord application. This means you may install the Bot to your personal Discord account and use it in various contexts, including servers where you have membership, direct messages, and private channels. You do not need server administrator permissions to use the Bot after installing it to your account.

3. Eligibility

By using Furiona, you represent and warrant that:

1. You are at least 13 years of age, or the minimum age required to use Discord in your jurisdiction, whichever is greater.
2. You have a valid Discord account in good standing.
3. Your use of the Bot complies with Discord's Terms of Service and Community Guidelines.
4. You have the legal capacity to enter into these Terms.

If you are using the Bot on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Acceptable Use

4.1 Permitted Use

You may use Furiona for its intended purpose: personal entertainment through anime-themed image viewing, social interactions with other Discord users, and anime information lookup.

4.2 Prohibited Conduct

You agree not to:

1. Use the Bot in any manner that violates Discord's Terms of Service or Community Guidelines.
2. Attempt to exploit, circumvent, or abuse any features of the Bot, including interaction restrictions designed to prevent self-targeting with action commands.
3. Use the Bot to harass, abuse, or harm other Discord users.
4. Attempt to reverse engineer, decompile, or extract source code from the Bot.
5. Use automated systems, scripts, or bots to interact with Furiona in an unintended manner.
6. Misrepresent your identity or impersonate others when using the Bot.
7. Use the Bot for any commercial purpose without prior written consent.
8. Interfere with or disrupt the Bot's functionality or the servers and networks connected to it.

4.3 Interaction Restrictions

The Bot includes built-in restrictions to promote positive interactions. Action commands that target another user cannot be used to target yourself. Interactive components such as buttons and dropdown menus are restricted to authorized users (either the command executor or the targeted user, depending on the component's purpose).

5. Third-Party Content and Services

5.1 Third-Party APIs

Furiona relies on third-party services to provide its functionality:

• nekos.best: Provides anime-style images for image, action, and expression commands. All content retrieved is filtered for safe-for-work material.
• Jikan API (MyAnimeList): Provides anime information for the search feature. Search results are filtered for safe-for-work content.
• Discord: The Bot operates within the Discord platform and is subject to Discord's terms and policies.

We do not control these third-party services and are not responsible for their content, availability, accuracy, or policies. Your use of Furiona constitutes acceptance of the terms and policies of these third-party services to the extent applicable.

5.2 Content Disclaimer

All images and anime information displayed through Furiona originate from third-party sources. We do not create, curate, or guarantee the accuracy of this content. While we configure all API requests to return safe-for-work content, we cannot guarantee that all content will be appropriate for all audiences or free from errors.

6. Intellectual Property

6.1 Bot Ownership

Furiona, including its code, design, and branding, is owned by wsquarepa productions. These Terms do not grant you any ownership rights in the Bot.

6.2 Third-Party Intellectual Property

Images provided through the Bot are sourced from nekos.best and are subject to their respective intellectual property rights. Anime information is sourced from MyAnimeList via the Jikan API. We do not claim ownership of any third-party content displayed through the Bot.

6.3 Discord Trademarks

Discord and related marks are trademarks of Discord Inc. Furiona is not affiliated with, endorsed by, or sponsored by Discord Inc.

7. Disclaimers

7.1 "As Is" Provision

The Bot is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

7.2 No Guarantee of Availability

We do not guarantee that the Bot will be available at all times or that it will function without interruption or error. The Bot's availability depends on Discord's platform, third-party API availability, and our hosting infrastructure. We reserve the right to modify, suspend, or discontinue the Bot at any time without notice.

7.3 Third-Party Reliability

We are not responsible for the availability, accuracy, or reliability of third-party services on which the Bot depends. If nekos.best, Jikan API, or other services experience downtime or changes, the Bot's functionality may be affected.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall wsquarepa productions, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

1. Your access to, use of, or inability to access or use the Bot.
2. Any conduct or content of any third party related to the Bot.
3. Any content obtained from or through the Bot.
4. Unauthorized access, use, or alteration of your interactions with the Bot.

9. Indemnification

You agree to indemnify, defend, and hold harmless wsquarepa productions and its developers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Bot, your violation of these Terms, or your violation of any rights of any third party.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through reasonable means, such as updating the "Last Updated" date at the top of this document. Your continued use of the Bot after any modifications constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically to stay informed of any changes.

11. Termination

11.1 By You

You may stop using Furiona at any time by uninstalling the Bot from your Discord account.

11.2 By Us

We reserve the right to suspend or terminate your access to the Bot at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, abuse of the Bot, or conduct that we determine to be harmful to other users or the Bot's operation.

11.3 Effect of Termination

Upon termination, your right to use the Bot will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the Bot shall be resolved through good-faith negotiation between the parties before pursuing any formal legal proceedings.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

14. Entire Agreement

These Terms constitute the entire agreement between you and wsquarepa productions regarding the use of Furiona and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter herein.
